Injured in an Oviedo car crash? You may have legal rights.
Oviedo sits at a unique crossroads. Just miles from the University of Central Florida and connected to Orlando by the Seminole Expressway, this city of nearly 42,000 draws commuters through State Road 434, Mitchell Hammock Road, Red Bug Lake Road, and Alafaya Trail every day.
That volume creates conditions where accidents happen regularly. Seminole County ranks among the highest in Florida for crashes per capita, and Oviedo residents account for a significant share of those crashes.
If you've been seriously hurt in a crash here, you're not just dealing with an injury. You're facing medical appointments, questions from insurance companies, and time away from work while trying to heal.
Osborne, Francis & Pettis represents car accident victims throughout Oviedo and Seminole County. We handle the insurance negotiations, gather the evidence that matters, and fight to recover what the crash has cost you.

So you've been in a car accident. What happens next? There are many things that you should do but here are the three most important:
Number One: See a doctor immediately.
A broken bone is easy to see, but some injuries are not. The most common injuries from car accidents happen in the neck, back, or head. The only way to diagnose and treat them is by seeing a doctor. A doctor can help ease the pain, provide medication, reassure you of how your injury may impact your daily life, and tell you what not to do to make it worse.
A visit to the doctor can also give you legally protected time off to recover and rest your body after an accident, and it documents and provides the evidence you may need for your case. Even a five-mile-per-hour car accident can cause a serious injury. So whether you've had a severe accident or a minor collision, see a doctor. And if you don't have medical insurance, let us know and we'll make sure that you receive the proper care.
Number Two: Write everything down.
Even if it seems small, during times of stress or injury it is common to forget the little details. Make sure you keep note of the pain that you're in. With neck, back, and head injuries, sometimes simple activities such as walking up the stairs or picking up a toddler may cause severe pain.
You may not be sleeping well at night. Documenting how much you sleep and how often you wake up due to pain is also very important. And lastly, if you have any cuts or bruises, take daily photos as you heal. This will provide visual evidence of the injuries that you've suffered.
Number Three: Do not speak to an insurance company until you've spoken to a lawyer.
Please understand that the insurance adjuster works for a billion-dollar corporation and not for you. Their interests are solely for their insurance company, and their goal is to provide you with the least amount of financial settlement as quickly as possible. When you do speak with them, remember they will record the conversation. Why do they do this? Because they've been trained to ask questions that may confuse you. So talk to us before you talk to them.
So remember: See a doctor, document everything, and call us before calling the insurance company for your free private consultation. We are here for you. Real tough lawyers fighting real tough issues.
After a crash, it might seem like things will work themselves out. The other driver admitted fault. You filed a police report. You may have even spoken to their insurance company. But these steps can sometimes hurt your case more than help it.
Insurance adjusters are not neutral investigators. Their goal is to lower the amount they pay, sometimes by questioning your injury or using things you said against you later.
Do not give a recorded statement before speaking to an Oviedo car accident attorney. Even an innocent comment like "I'm feeling better today" can be used to deny coverage for treatments you still need.
When you work with Osborne, Francis & Pettis, we handle the insurance company so you don't have to. We gather the evidence needed to build your case and demand compensation for what this crash has cost you.
In this short video, attorney Greg Francis explains how early decisions, like talking to an insurer, can affect your claim.

Types of Car Accident Cases We Handle
A driver who causes a crash through carelessness can be held responsible under Florida law. We help clients injured in car accidents caused by:
Distracted drivers who were texting, adjusting GPS, or not watching the road;
Aggressive drivers who tailgated, cut off other vehicles, or ran red lights;
Drowsy drivers who lost focus or drifted out of their lane; and
Wrong-way drivers who entered roads or ramps incorrectly.
Our Oviedo car accident lawyers also handle cases where crashes result in death. If you've lost a family member in a collision caused by someone else, you may be able to file a wrongful death claim.
Injured in a crash caused by someone else? You may be entitled to compensation for your medical bills, lost wages, and other damages. The sooner you speak with an attorney, the sooner we can start building your case.

Compensation Available to Car Accident Victims
When we take on a case, our goal is to recover compensation that reflects the full impact of the crash. Florida law allows victims to pursue damages for both financial losses and personal harm. These include:
Medical Expenses
Crash victims often face mounting medical costs. Treatment may include emergency care, imaging scans, surgery, medication, rehabilitation, and follow-up appointments. Some injuries require ongoing treatment long after the initial crash.
Our Oviedo car accident attorneys work with medical professionals to document the full scope of treatment and project future costs so nothing is left out of your claim.
Lost Income
Serious injuries can keep someone out of work for weeks or months. Missed paychecks, reduced hours, and changes in job duties can disrupt financial stability. In some cases, long-term injuries may limit future earning capacity.
Property Damage
A crash can total a vehicle or leave it in the shop for extensive repairs. Victims may also lose personal items inside the car, such as electronics or work equipment. Rental car costs, towing fees, and transportation expenses add up.
Pain and Suffering
Not all losses can be measured in dollars. Chronic pain, limited mobility, anxiety, sleep disruption, and emotional distress can make daily life difficult. These effects can alter routines and reduce a person's quality of life.
Wrongful Death
For some families, the crash brings a far greater loss. If a loved one dies because of another driver's negligence, compensation may include funeral and burial costs, loss of companionship, and the future financial support the victim would have provided.
No amount of money replaces a life, but pursuing a claim can help ease some of the burden during a difficult time.
What Our Oviedo Car Accident Lawyers Have Recovered for Clients
Insurance companies have teams of adjusters and attorneys working to minimize what they pay. Without a lawyer, most car accident victims don't receive the full amount they're owed.
"For me, it always comes back to one question: what will it take to help this person recover their life? That's what I work for in every case."
— Joseph Osborne
We've helped clients recover:
$7.5 million for a passenger struck while waiting at a red light. His recovery required extended hospital stays, ongoing rehabilitation, and changes at home to manage daily life. The settlement covered continued medical care and replaced the income he could no longer earn.
$2.5 million for a driver rear-ended by a box truck. Neck and back surgeries limited her mobility, and months of rehab kept her out of work. The settlement accounted for lasting effects on her career and independence.
$985,000 for a driver who was sideswiped in traffic. The car damage was minimal, but spinal fusion surgery left him with lifelong restrictions. Compensation addressed the costs of surgery and ongoing treatment, as well as the financial strain on his family during his recovery.
Hiring an Oviedo car crash lawyer makes a difference. A Martindale-Nolo survey found that people with legal representation received settlements that were, on average, 3.5 times higher than those who negotiated on their own.
How Florida Law Affects Your Claim
Getting fair compensation isn't just about proving the other driver caused the crash. Florida has specific rules that can affect how much you recover, or whether you recover anything at all. Here's what car accident victims in Oviedo need to know.
Comparative Negligence
If you're found partially at fault for the crash, your compensation is reduced by your percentage of responsibility. If you're more than 50% at fault, you cannot recover anything. Insurance companies often try to shift blame onto victims to lower what they pay.
Accident reconstruction, traffic camera footage, and witness statements can counter these tactics and establish what actually happened, which is why building a strong case early matters.
Statute of Limitations
You generally have two years from the date of the crash to file a personal injury lawsuit or wrongful death claim. Missing these deadlines can bar you from recovering compensation entirely.
Between medical treatment and drawn-out negotiations with insurers, months can slip by quickly. Having legal representation ensures that deadlines are met and your case is filed on time.
No-Fault Insurance and PIP
Florida is a no-fault state. Your own personal injury protection (PIP) coverage pays for initial medical expenses and lost wages, regardless of who caused the accident. But PIP only covers up to $10,000, which often isn't enough for serious injuries.
Filing these claims and knowing when to pursue compensation beyond PIP is part of what we handle for clients.
When You Can File a Claim Against the Other Driver
If your injuries meet the serious injury threshold (permanent injury, significant scarring or disfigurement, or death), you can file a claim directly against the at-fault driver for full compensation beyond what PIP covers.
Insurance companies sometimes argue that injuries don't meet this threshold to avoid paying out. We know how to fight that.

“I couldn’t have asked for a better lawyer/ firm — everything was done professionally exactly how I wanted. Due to COVID my personal attorney Mr. Garcia was still able to make things work in a timely manner and he never made me feel like he wasn’t working. Overall I’m happy with how my case turned out and I would recommend him and this law firm to anyone. 100% satisfied.”

“I am so thankful for EVERYONE, the entire staff at Osborne & Francis Law, for mentoring me through the mediation process with my hip replacement failures. I didn't realize how MUCH pressure they relieved me of by helping me deal with the reality of this traumatic time in my life, as it was OVER so quickly with a positive result. My family is grateful to have their mom HAPPY & FOCUSED on the future, rather than worrying over what happened in the past! FAST FORWARD, we are LIVING LIFE to the fullest once again!”

“Attorneys Greg Francis and Ryan Fletcher at Osborne & Francis Law Firm represented me in my personal injury case. The defendant drew a line in the sand and was adamant on a settlement amount I was almost willing to accept. After the dust settled and the smoke cleared, we settled for 3 times that amount!!! When they say ‘Real Tough Lawyers,’ they mean it.”
E. Holland
Dennis and the other Osborne & Francis staff were amazing! Our case was HUGE and required tender loving care. Everyone on our case did their part by putting all the puzzle pieces together. We were given step by step updates and put at ease when our nerves got the best of us. For every inquiry we made we received a timely response...You are appreciated!

Quick and fair resolution to a unique case. On advice of my own attorney, I engaged Joseph Osborne of Osborne & Francis of Boca Raton, FL. Mr. Osborne had considerable experience in cases such as mine and the results showed that. Mr. Osborne and his staff were very helpful, kept me up to date, and listened to my input. The settlement was very fair as far as I am concerned.

Speak With an Oviedo Auto Accident Lawyer Today
If you've been hurt in a crash, the insurance company is already working to protect its bottom line. You need someone working just as hard for you.
At Osborne, Francis & Pettis, we've spent more than a decade representing car accident victims and have recovered over $1 billion for our clients. We know how insurers operate, what evidence matters, and how to build cases that get results. From the first phone call to the final resolution, we handle the legal work so you can focus on getting better.
Hit-and-run accidents are common in Oviedo and throughout Seminole County. If the other driver can't be identified, your own uninsured motorist coverage may provide compensation. An Oviedo auto accident attorney can review your policy and help you pursue all available options.
How much is my case worth?
Case value depends on many factors: the severity of your injuries, the cost of your medical treatment, how much work you've missed, and how the accident has affected your daily life. We evaluate both current losses and future impacts to pursue full compensation.
Do I need a lawyer if I have insurance?
Insurance companies, including your own, are businesses focused on minimizing payouts. Studies consistently show that accident victims who hire attorneys recover significantly more than those who handle claims alone. An Oviedo car accident lawyer ensures you don't leave money on the table or make mistakes that hurt your case.
How long does a car accident case take?
It depends on the complexity of the case and whether the insurance company is willing to offer fair compensation. Some cases settle in months. Others, especially those that go to trial, can take longer. We keep clients informed throughout and don't rush settlements that undervalue the claim.
