Kenneth J. Miller is a partner in the Fort Lauderdale office of Haliczer Pettis & Schwamm. Ken has extensive trial experience in the areas of medical malpractice, premises liability and personal injury. Recent Successes

  • By the time the intense 3-week jury trial concluded, obtained in excess of $8.2 MILLION for the clients, the family members who were tragically left behind when the victim died due to improper technique during cardiac surgery.
  • $4,050,000 settlement on behalf of the client, who suffered a tragic delay in diagnosis of lung cancer. The radiologist assigned to the client failed to identify an abnormal lesion on a CT scan, which would have been immediately diagnosed as Stage 1 Lung Cancer. 20 months later, the same radiologist interpreted another scan and identified the lesion, which by that time, had increased significantly in size. The client now suffers from the pain and mental trauma of not being diagnosed in a timely manner and is now dealing with the treatment of Stage 4 cancer, with a shortened life expectancy.
  • $3 MILLION wrongful death settlement on behalf of the family of the victim, a husband and father of two, who died from complications resulting from a minor medical procedure. The victim went into the hospital for a bone spur repair and unfortunately suffered from acute respiratory distress after the procedure. He was then transferred to the ER. While at the ER, there were multiple signs that our client was still in distress, however, the responsible health care professionals failed to properly intubate him and as a result, the victim died from cardiac arrest.
  • $2 MILLION medical malpractice settlement on behalf of the client, who suffered from an open fracture of the ankle and fell into a body of water. The surgeon assigned to repair the open fracture failed to recognize that because the client sustained the injury while in water, they were exposed to a significant level of bacteria, and the surgeon did not prescribe the right antibiotics to treat the potential infections post-operatively surgery. Because of this lack of treatment, our client suffered severe bacterial infections and had to undertake multiple follow-up surgeries The client was thankful for our legal team’s advice and counsel. “We appreciated your honesty throughout this case, you remained open and candid with us when it was good news, just as much as when it was bad news. $4,500,000 - Diagnosis Error

Settlement on behalf of our client who did not receive timely medication in the Emergency Department to treat an evolving stroke, which left him with permanent injuries and neurologic deficits. The doctors and nurses involved failed to correctly diagnose his true condition and failed to administer clot-busting medication in a timely manner. 

The claim was amicably resolved with all medical providers and their insurance companies prior to a lawsuit being filed.

$1.625 - Million Medical Malpractice Settlement

Our 67-year-old client faced serious complications following hernia repair surgery. During recovery, he needed breathing and oxygen support. However, the physician chose an inappropriate method of respiratory support, opting for a mask with forced airway pressure instead of intubation. This misstep resulted in a tear in the client's esophagus, which the surgery had already weakened. Consequently, our client suffered catastrophic health issues, underwent additional surgery, and fortunately survived.
